My divorce is supposed to go through next month, and my ex has been atrocious. Before the divorce I was a stay at home mother, and I have two little boys under the age of 5 whom I have sole custody of. Since I had been out of the workforce, my parents took us in and though I have tried to works several jobs, my unemployed ex husband has employed several very creative and devious ways to keep me from staying employed, from harassing calls, to absconding with a child. I still have bills, and though my parents can help, and have, I would rather do it myself. I am a talented seamstress and started to sew infant car seat covers and sell them on my city’s online classified site. they const about $10-$15 dollars to make and sell for $25-$30 a piece. Thus far I hav sold two, and have 3 more ready to go. My ex found out about it and began screaming that since we aren’t divorced yet, he is entitled to half of my “business” and that he’ll sue me for tax evasion and that he;ll sue for the ‘business and take it from me’. For one, its not tax season yet, and I have kept receipts of materials and of purchases, and intend to claim it and for 2, its not really a business. Its not large-scale, I’ve made $40 in profit. Can he even do this, or is he just being an entitled jerk? I mean, he isn’t working, and hasn’t worked for two months, paid nothing to help the kids and done nothing but harass me day and night. I think I should be entitled to profits from my own ingenuity, and its diapering my baby.
Is there even a ‘business’ to sue for?

    The answer to your question is typically found in the marital property laws within individual states.
    In order to know how property is divided in a divorce it is important to do some research and find out whether you live in a community property state. There are other factors that can affect the outcome of property division when a marriage ends and those too can vary by state but also can be determined by individual judges. Knowing the history of how a judge has ruled in divorce cases can be valuable but your attorney should know.
    In your case, there isn’t anything to divide yet. Have you filed an LLC in your state? Do you have a tax ID number? If not, there truly isn’t anything to prove that you have a business since as you stated there hasn’t been any real income from the business to this point.
    You don’t owe any taxes because you haven’t reached the point of profitability.
    Sounds like your soon-to-be-ex is feeling insecure about your pending success otherwise he would not have reacted that way.
