How Long Do I Need To Wait Before Relisting An Unpaid Item On Ebay? Two Part Question…?

I am selling a phone with a cracked screen on eBay. Someone bought it, but hasn’t paid yet. It’s been 3 days. The person has 0% rating. Can I relist now or do I need to wait?
*recently I purchased a new phone. I bid on an auction and was oitbid. I upped my bid and mistakenly thought I had been outbid again. So I found a ‘buy it now’ that I ordered. I ALWAYS pay as soon as I buy something, but when I went to paypal it turned out I had actually won the auction listing. I sent a letter to the BIN seller explaining what had happened and apologized. He still opened a case on me, which although I hate (I have a 100% rating) I could still understand. I tell you this because I am wondering if this seller could possibly be the buyer of my phone? It’s a conspirators theory. What do you think?
