I just found out I defaulted on a school loan as of Dec.11, 2011. If & when I file taxes Jan of Feb. of 2012, will the IRS take my taxes or do they give me time to set up payment plans or etc. I just got out of a 7 year relationship with someone & decided to buckle down & get my degree. I left him & moved and got a new address so I didn’t get a notice. Then I get this news after applying for financial aid. I’m devastated. Answers please. Thanks



Student loans are IRS certified once a year…around October. So you missed it. If you dont make a payment plan before October 2012 then u will be certified for a tax offset. Call your student loan servicer and request payment options or programs such as a rehabilitation or consolidation.
I defaulted on my student loan about 6 years ago the IRS didn’t take my tax return instead the federal student loan started to garnish my wages at about 12 percent a week. It takes about 6 months to a year after default to have this done to you the IRS doesn’t get involved with taking your tax return unless you change jobs a lot through out the year. Student loans don’t need to take youvto small claims court to garnish wages they by law ate allowed to do it whenever they want. It pretty easy to get back on a monthly payment plan if you do start getting your wages garnished
once you are in default and the agency has notified IRS of the default it will be effective for any current refund
