You have a signed contract, but do you have a signed receipt for the down payment? If not, pay it.
If the down payment is part of the contract they most certainly have a legal right to collect it. Regardless of whether they asked for it or not. You are legally obligated to pay it.
If they wrote the contract without a down payment then you are not required to pay one.

If you do not pay as you agreed to (when you signed the contract), then they can press charges.
