I am a breeder who co owns a stud adult dog. We bred our male to a female that was co owned by two other breeders- all parties are with the UKC registry. Before the breeding we signed a contract that in lue of cash for the stud fee, we would take two puppies back as payment (first pick overall and third pick overall). We discovered that the female had given birth by word of mouth and we grew suspicious.
6 weeks later we were notified that they attempted to submit the litter registration without our signatures (which is not allowed by the registry). UKC stated that in order to register the litter, that a hand written letter by my partner and I needed to be submitted acknowledging the breeding.
Now to the point.
When we spoke on two occassions via phone conversation and text message I was told that 7 were born and one died, leaving 6 alive- 5 females and one male. When I contacted the registry to see if what the other breeders said was accurate I found that they were trying to register 9 puppies instead of 6. Now i don’t feel comfortable doing any sort of business with them because they lied to me and what they are attempting to do is fraud.
Do I have any recourse? My male did his part and produced 6 or 9 puppies, which ever is the truth. Would I be in trouble if I don’t sign off since we both signed the above mentioned contract? Should I sue him for the cost of stud fee? he planned on selling the puppies for $1,500 a piece, my male is much more known than his- I did him a huge favor at offering a stud fee of $1,000, then just taking 2 pups as payment. Any advice is accepted! Please help me, I plan on bursting his bubble after some careful thought on the matter. I just want to do the right thing, legally without hurting my interest.
Things to consider..
- It was not a mistake, we both have been breeding dogs for years and they fully know the process.
-If I fight this and go back and forth about registering the pups they will only get older and it is much more difficult to sell a puppy older than younger in many cases.
-He, in my opionion, was a reputable breeder up until this point- I would have never done the breeding with him had this not have been the case.

Wow, what a mess.
Before you make a decision, I suggest you contact someone again at the Registry to discuss the matter further and get their input. You KNOW there is fraud. First, the breeder tried to register the litter without obtaining the stud-owner’s (your) signatures. Second, there is a discrepancy in the number of pups in the litter….is it 6, is it 9, or is it 6 of your stud’s and 3 from another similar-aged litter that would sell for more having your stud listed as the sire? Ask about requiring a parental DNA test before ANY of these puppies are registered, even if you don’t plan to take puppies back.
I’d have to think more about this, but my first inclination is to tell UKC that the only way you will sign the form for these pups is if they all have DNA tests proving your dog actually sired them.

You might want to ask that in the legal section here at Y!A, and also the UKC Registry. But since there is a discrepancy in the number of pups in the litter, IMHO you would be well within your rights to refuse to sign until DNA proof is provided about which pups are actually sired by your dog. Also, DO NOT SIGN until you have been paid in full (either the pups or the money) or you’ll likely have to take the breeder to court to get paid–and may have trouble collecting the judgment even if you win the case. This person has proven to be deceitful once, no reason to think he won’t try it again.

You write UKC(there’s your problem-they’ve turned whore to BYBs & mills) to tell them you refuse.

well if u take it to court like u sed the pups will get older, they are hiding puppies because they are of better show quality, but at this point in my opinion, i would go and take the 2puppies and cut ur loses, just dont deal with him anymore
yes you can get in contact with ukc have them send you something that states how many pups they are trying to register, then have the people write you a statement as to how many pups that their dog had, and take them to small claims court.
I wouldn’t sign, until you view all pups in person, take your pick, they take a pick and you take a pick. Hiding 2 pups from you which are obviously their top 2 picks would be a breach imo, and I wouldn’t sign anything until it was dealt with.
Without you signing, they can’t register the litter. If they can’t register it, they can’t sell them as purebreds. What would they rather lose out on- their top 2 picks, or the entire litter….
I also wouldn’t work with them again.
Speak with your lawyer, and also inform the breeds national club, as well as the UKC..
